Terms of Service

These Terms of Service ("Terms") govern your use of the SCENDmobile application (the "App"), operated by Mohammad Alhabbal as SCEND("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you meet this requirement and, if applicable, that any account information you provide is accurate.

2. The Service

SCEND provides AI-generated strength, calisthenics and conditioning programs, workout tracking, an exercise library and AI coaching chat. Guest assessment answers are sent through our server to our AI provider with your permission. Guest progress resets on a fresh app start. Accounts support cloud saving and signed-in features. Images saved to Photos are separate copies you control. See the Privacy Policy for processing details.

Exercise-video links use YouTube API Services. By using this feature, you agree to the YouTube Terms of Service. Videos open on YouTube and remain the property of their respective creators; linking does not imply endorsement or ownership by SCEND.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You can delete your account at any time from the App's profile screen. Successful deletion removes associated active account records and uploaded photos; provider logs and backups may remain for their retention periods, and exported Photos remain under your control. 4. Purchases

All Shop offers currently display Coming soon and checkout is unavailable. The current app does not collect Shop payments. Before an offer becomes available, its final price, scope, delivery and applicable cancellation or refund terms will be shown.

5. User Content

You retain ownership of your profile and progress photos, workout notes and Coach messages. You permit us and our service providers to process this content as needed for the features you use, as described in our Privacy Policy. Do not upload information you lack the right to share. Human Form Check video submission and paid delivery are not yet available.

6. AI-Generated Content and Fitness Disclaimer

Training programs, exercise information, and AI coach responses in the App are generated by an AI system and are provided for informational and educational purposes only. They are not medical advice, and following them is at your own risk. AI-generated content can be inaccurate or unsuitable for your specific circumstances. Consult a physician before starting any new exercise program, especially if you have a pre-existing condition, injury, or health concern, and stop immediately if you experience pain, dizziness, or discomfort.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or gain unauthorized access to the App or its backend systems.
• Interfere with or disrupt the App's servers or networks.
• Impersonate another person or misrepresent your affiliation with any person or entity.

8. Intellectual Property

The App, including its design, code, exercise library, and branding, is owned by SCENDand protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

9. Termination

We may suspend or terminate your access to the App at any time if we believe you have violated these Terms. You may stop using the App and delete your account at any time.

10. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee the App will be uninterrupted, error-free, or that any training program will produce specific results.

11. Limitation of Liability

To the fullest extent permitted by law, SCEND is not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including injury sustained while following a training program. Our total liability for any claim related to the App will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.
